Sejak 26 Agustus, 295 produsen telah menerima MDO (Managed Development Order) untuk lebih dari 1.089.000 produk. Sejak batas waktu 9 September untuk menarik produk yang tidak berizin dari pasar, Pusat Produk Tembakau FDA belum mengizinkan produk rokok elektrik apa pun untuk dipasarkan. Produk yang ditolak oleh PMTA (Pharmaceutical Marketing and Tobacco Products Act) harus ditarik dari pasar atau dikenakan tindakan penegakan hukum lebih lanjut oleh FDA.FDA menyatakan bahwa prioritas penegakan hukum utamanya mencakup produk-produk yang telah menerima MDO atau yang belum pernah diajukan untuk ditinjau. Namun, semua produk yang tersedia saat ini secara teknis masih tunduk pada kebijakan penegakan hukum FDA, termasuk produk-produk dari produsen rokok elektrik pasar massal seperti Juul Labs dan merek Vuse dari Reynolds American.Dengan putaran pertama MDO, FDA mengumumkan standar yang sebelumnya belum dipublikasikan yang mengharuskan PMTA digunakan untuk produk perasa selain tembakau dan mentol untuk menunjukkan bahwa bukti ilmiah produk spesifik yang memadai membuktikan manfaat yang cukup bagi perokok dewasa, serta mengatasi risiko yang terkait dengan tembakau dan mentol.Untuk pertama kalinya sejak FDA mengumumkan persyaratan tersebut, mereka menolak untuk membuka akses bagi produsen sistem yang memiliki sumber daya untuk menyertakan bukti tersebut dalam PMTA mereka. Sebelumnya hari ini, produsen e-liquid AS Turning Point Brands dan AVAIL Vapor adalah salah satu perusahaan yang menerima MDO minggu ini, terutama untuk aplikasi produk rokok elektrik beraroma.Pihak lain yang diyakini telah menyerahkan sejumlah besar bukti ilmiah dalam PMTA mereka juga telah menerima MDO, termasuk produsen rokok elektrik sekali pakai Bidi Stick. Beberapa produsen e-liquid ternama dan sudah lama berdiri juga telah menerima MDO, termasuk Beard Vape Company, Cosmic Fog, Ruthless, dan Mister E-Liquid.Daftar Perintah Penolakan Pemasaran (Marketing Denial Orders/MDO) per 17 September 2021

Meskipun FDA menyatakan telah mengeluarkan 295 MDO (Medical Designation Order), daftar tersebut hanya berisi 240 nama. Badan tersebut mengatakan bahwa produsen tidak menyebutkan nama produk yang saat ini tidak berada di pasaran yang ditolak.

Daftar tersebut disusun berdasarkan urutan abjad, dan tanggal rilis MDO ditunjukkan di sisi kanan setiap nama.
